This policy explains how to report content on SpawnJet that you believe infringes your copyright, and how customers can respond. It's part of our Terms of Service.
1.Our policy
SpawnJet respects intellectual property rights and expects our customers to do the same. We respond to notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act (“DMCA”) and other applicable laws.
When appropriate, we remove or disable access to material claimed to be infringing, notify the affected customer, and follow the DMCA counter-notice process described below.
2.Submitting an infringement notice
To report content hosted on SpawnJet that you believe infringes your copyright, send our designated agent a written notice that includes:
- A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
- Identification of the copyrighted work you claim is infringed, or a representative list if your notice covers several works on SpawnJet.
- Identification of the material you claim is infringing and enough information for us to locate it, such as the server address and the file or resource name.
- Your name, mailing address, telephone number and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.
3.Designated agent
Send notices to our designated copyright agent:

4.What happens after a notice
We review notices for the information the DMCA requires. If a notice is incomplete but identifies the copyrighted work, the material at issue and a way to contact the sender, we may ask the sender for the missing information.
For a valid notice, we act expeditiously to remove or disable access to the material when appropriate. We take reasonable steps to notify the affected customer and may give them a copy of the notice, including the complainant's contact information. We may also share the notice as required by law or to administer this process.
5.Counter-notices
If your content was removed and you believe it was a mistake or misidentification, or that you have the right to use it, you can send a counter-notice to our designated agent that includes:
- Your physical or electronic signature.
- Identification of the material that was removed and where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you're outside the United States, any judicial district in which SpawnJet may be found), and that you will accept service of process from the person who sent the original notice or their agent.
We'll forward a valid counter-notice to the person who sent the original notice. If they don't tell us that they've filed a court action seeking to restrain the alleged infringement, we may restore the material no sooner than 10 and no later than 14 business days after receiving the counter-notice.
6.Repeat infringers
SpawnJet has adopted a policy of terminating, in appropriate circumstances, customers and account holders who are repeat infringers. We may also suspend or terminate accounts based on a single serious infringement or other violations of our Acceptable Use Policy.
7.Misrepresentation
Under the DMCA, anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages. If you're unsure whether material infringes your rights, consider talking to a lawyer before sending a notice.
